Terms and Conditions of Use

The Sunway Talent Intelligence Platform is an AI-enabled student success and talent development platform designed to support students throughout their academic journey and beyond.

The Platform aims to provide personalised recommendations and opportunities relating to:

• Academic planning
• Career exploration
• Employability development
• Internships
• Success X-Factor Coaching
• Industry engagement
• Alumni networking
• Lifelong learning
• Career opportunities

The Platform is intended to augment—not replace—academic advising, career coaching, counselling, or professional judgement.

The Platform is being made available as part of a limited pilot or minimum viable product (“MVP”) programme for evaluation, testing and service improvement purposes.

Students acknowledge that certain Platform features are still under development and may be incomplete, unavailable, changed, withdrawn or contain technical defects, inaccuracies, delays or unintended results.

Participation in the pilot is voluntary unless otherwise communicated by the University. The University may modify, suspend or discontinue any pilot feature at any time without prior notice where reasonably necessary for operational, security, academic or technical reasons.

No representation or warranty is made that the pilot version of the Platform will be suitable for every student, meet all individual requirements, or operate without errors or interruptions.

Students should report any output that appears inaccurate, inappropriate, discriminatory, harmful or inconsistent with official University information through the Platform’s designated helpdesk or ticketing channel.

The Platform is available to:

• Prospective students (where applicable)
• Current Sunway University students
• Graduates
• Alumni
• Approved lifelong learners

Access is provided using authorised Sunway University credentials or approved registration methods.

By using the Platform, you consent to Sunway University collecting, storing, processing and analysing relevant personal information for educational and student success purposes.

This may include:

• Student profile
• Academic records
• Course enrolment
• Attendance
• Participation records
• Co-curricular activities
• Internship participation
• Career development activities
• Employability records
• Coaching interactions
• Alumni engagement
• Learning preferences
• Platform usage data

Information will be managed in accordance with applicable Malaysian data protection legislation and Sunway University’s privacy policies.

Sunway University is committed to protecting student privacy.

Personal information will only be accessed by authorised personnel with legitimate educational or operational responsibilities.

Where third-party technology providers are engaged, appropriate contractual and security safeguards will be implemented.

To improve student success and institutional services, anonymised and aggregated data may be analysed for:

• Student success initiatives
• Academic planning
• Employability reporting
• Institutional research
• Service improvement
• AI model enhancement

Personally identifiable information will not be publicly disclosed without consent unless required by law.

The Platform uses Artificial Intelligence to generate personalised recommendations.

These recommendations may include:

• Academic pathways
• Elective suggestions
• Career pathways
• Internship opportunities
• Industry events
• Coaching recommendations
• Microcredentials
• Lifelong learning opportunities

Students acknowledge that:

• AI recommendations are advisory only.
• Final academic decisions remain with the student and relevant academic authorities.
• Career recommendations do not constitute employment guarantees.
• AI outputs may evolve as additional information becomes available.

Sunway University is committed to the responsible use of Artificial Intelligence.

AI recommendations are designed to:

• Support human decision-making.
• Reduce administrative burden.
• Improve student outcomes.
• Enhance personalised learning.

The Platform does not make autonomous decisions regarding:

• Academic progression
• Graduation
• Student discipline
• Employment outcomes

Human oversight shall remain an integral part of all significant decisions.

Students agree to:

• Maintain accurate personal information.
• Keep login credentials secure.
• Use the Platform responsibly.
• Update career interests where appropriate.
• Respect the privacy of other users.
• Use AI tools ethically.

Students shall not:

• Misrepresent qualifications or achievements.
• Upload misleading information.
• Attempt to manipulate recommendation algorithms.
• Share confidential employer information.
• Use the Platform for unlawful purposes.

Where applicable, the Platform may generate a digital Employability Passport containing verified competencies, experiences and achievements.

Verification may include:

• Academic achievements
• Internship completion
• Leadership roles
• Student activities
• Industry projects
• Microcredentials
• Coaching participation

Only verified records approved by Sunway University or authorised partners will be displayed.

The Platform may recommend:

• Internships
• Graduate positions
• Industry projects
• Mentoring opportunities
• Networking events

Participation in these opportunities does not guarantee:

• Internship placement
• Employment
• Scholarships
• Selection by employers

Recruitment decisions remain solely with participating organisations.

All software, algorithms, designs, dashboards, content, trademarks and proprietary technologies associated with the Platform remain the intellectual property of Sunway University and its authorised partners unless otherwise stated.

Confidentiality and Restricted Use

Users shall not reproduce, distribute or commercially exploit any part of the Platform without prior written approval from Sunway University and these include but are not limited to:

• Copy, reproduce, record, publish or distribute any non-public Platform content, design, workflow, screen, report or AI output;
• Share screenshots, login access, demonstration materials or confidential information with any third party;
• Use Platform materials for commercial purposes or to develop, benchmark or improve another product or service; or
• Attempt to reverse engineer, extract, replicate or interfere with the Platform’s software, algorithms or security features.

This restriction does not prevent students from sharing their own personal information or outputs where permitted by the University and applicable law.

Sunway University will make reasonable efforts to ensure continuous availability of the Platform but does not guarantee uninterrupted access.

Temporary interruptions may occur due to:

• System maintenance
• Security updates
• Technology upgrades
• Network disruptions

Sunway University reserves the right to:

• Add or remove features
• Improve AI capabilities
• Modify recommendation engines
• Introduce new services
• Update these Terms and Conditions

Students will be notified of significant changes where appropriate.

Sunway University may alter or amend these Terms and Conditions. By continuing to use the Platform after such amendment, you shall be deemed to have accepted any amendment to these Terms and Conditions.

While reasonable efforts are made to ensure the accuracy of information and recommendations, Sunway University shall not be liable for decisions made solely based on AI-generated recommendations or third-party opportunities.

Students are encouraged to seek guidance from academic advisors, Success Coaches, Careers X Alumni (CXA), and other University support services when making important academic or career decisions.

The Platform, including any AI-generated recommendations, insights, information, opportunities or outputs, is provided for educational, advisory and student success purposes only. Such information should not be treated as professional, academic, career, legal, financial, medical, psychological or employment advice, nor as a guarantee of any academic, employment, internship, scholarship, career or other outcome.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia and you irrevocably submit to the exclusive jurisdiction of the courts of Malaysia to settle any dispute which may arise out of or in connection with these Terms and Conditions.

If you live outside Malaysia, Malaysian law shall apply only to the extent that Malaysian law shall not deprive you of any legal protection accorded in accordance with the law of the place where you are habitually resident (“Local Law”).

In the event Malaysian law deprives you of any legal protection which is accorded to you under Local Law, then these Terms and Conditions shall be governed by Local Law and any dispute or claim arising out of or in connection with these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the courts where you are habitually resident.

You may print and keep a copy of these Terms and Conditions, which form the entire agreement between you and Sunway University and supersede any other communications or advertising in respect of the Platform.

No delay in exercising or non-exercise by you and/or Sunway University of any of its rights under or in connection with these Terms and Conditions shall operate as a waiver or release of each of your or Sunway University’s rights. Rather, any such waiver or release must be specifically granted in writing signed by the party granting it.

If any part of these Terms and Conditions is held unenforceable, that part shall be enforced to the maximum extent permissible to give effect to the intent of the parties, and the Terms and Conditions shall continue in full force and effect.

Sunway University shall not incur any liability to you on account of any loss or damage resulting from any delay or failure to perform all or any part of these Terms and Conditions if such delay or failure is caused, in whole or in part, by events, occurrences, or causes beyond the control of Sunway University.

Such events, occurrences or causes include, without limitation, acts of God, strikes, lockouts, server and network failure, riots, acts of war, earthquakes, fire and explosions.

By selecting “I Agree”, you confirm that:

• You consent to the processing of your information for the purposes described.
• You understand that AI recommendations are advisory and not determinative.
• You agree to use the Platform responsibly and ethically.
• You acknowledge that participation is intended to enhance your academic, employability, and lifelong learning journey.
